The Indictment for attempted murder stated that the plot took place between Dec. 12 and Jan. 18. Messer and Hoskins each has been released on a bond. Lawyers to rank candidates The Greene County Bar Association will rank the sit candidates for appointment to a vacant Greene County common pleas judgeship instead of just determining whether each candidate is qualified.

Attorneys said they agreed to rank the candidates after a closed door discussion. The vacancy was created when Judge Herman Weber resigned to take a seat on the 2nd District Court of Appeals. The bar will do the ranking Tuesday and submit the list to a Republican judicial screening committee scheduled to meet Wednesday. The screening committee will report to the Greene County GOP Central committee, which Is to recommend a candidate to Gov. James Rhodes April 5.

Man must pay back funds A Pennsylvania man found guilty of bilking four area residents of $13,000 has received a suspended sentence and has been ordered to repay the money as part of his probation. Irwin Berman, of Carbondale, was given a suspended sentence of two to five years in prison by Montgomery County Common Pleas Judge George Gounaris, according to Theodore Shaman, head of the Montgomery County prosecutor's consumer frauds sections. Berman and three people from Chicago were Indicted on four counts each of theft by deception for selling franchises for Sports Tournaments Network Inc. and a subsidiary, Travel-Log of America but then not providing the franchises. Charges against the three Chicagoans were dropped.

According to the terms of Berman's probation, he Fairborn man sentenced XENIA A Fairborn man on probation yesterday pleaded guilty to contributing to the unruliness of a minor in connection with an incident last month when he was found nude in van with a 13-year-old girl. Jackie W. Cox, 43, was sentenced in Greene County Juvenile Court to the maximum six months in jail. He also was fined $100 in the first degree misdemeanor. Also yesterday, in Greene County Common Pleas Court, Cox pleaded guilty to possession of a weapon while on probation.

Sentencing was set for April 28. He faces a maximum of five years in prison and a $2,500 fine for the fourth degree felony conviction. In return for the guilty pleas, authorities agreed to drop a charge of possession of a sawed off shotgun and release him from probation. Cox had been on probation in Montgomery County for a drug abuse conviction last year. Cox was charged after he was found in the van with a half dressed girl in the parking lot of the Skyborn Cruise In, Ohio 235 and Haddix Road, across from Wright Patterson Air Force Base.

Greene County sheriff's deputies found the shotgun and a bottle of pills when they searched the van. Other guns were found at the Fairborn Motel, 15 N. Broad where Cox was staying at the time. Change of venue requested A change-of-venue motion has been filed In the trial of George Messer, 40, and Diane Hoskins, 19, who have been charged with attempting to hire a man to kill Messer's wife and mother-in-law. Montgomery County Common Pleas Court Judge Robert Brown yesterday ruled that the motion was premature.

He said before the motion could be considered, an attempt must be made at the April 19 trial to seat a jury. Defense attorney Russell Carter asked the court to move the trial out of the county on the grounds that the defendants cannot get a fair trial because of the news coverage.
